By the end of this session you will:


- Understand all proper disclosures that must be made to clients and customers before and during the multiple representation process


- Learn what to have clients sign if the buyer refuses to conduct their own home inspection in a bidding war


- Understand the proper use of form 801


- Understand how to use form 244 (Seller’s Direction re Property/Offers) when not planning to consider offers until a later time period


- Learn whether you can sue a seller for commission when they refuse to accept an offer higher than the listing price


- Understand when you can make a pre-emptive or bully offer


- Learn what you must do if your seller is willing to consider a preemptive or bully offer


- Understand what to do if you are suspicious that the seller even has a second offer


- Learn when you must disclose the existence of multiple offers, either before an offer is signed, during any signbacks or during the home inspection condition period


- Learn the legality of escalation clauses (“the buyer agrees to pay $5,000 more than the highest offer received”)


- Understand how to manage the process when you, as the listing salesperson, are approached by a potential buyer asking


to be represented by you for this property.

- Learn what to do as a listing salesperson when a buyer salesperson wants to reduce their commission during a bidding war


- Understand how a seller can sign back more than one offer during a bidding war


- Learn how to create a bidding war for a buyer, as between 2 different
